Please read these Terms and Conditions carefully before enrolling. By making payment or signing an enrolment form, you confirm that you have read, understood, and agreed to these terms in full.
1. Definitions
"Company" means FindExperience™, a trademark and trading entity operating under the commercial authority and ownership of CultureTech Holdings, a South African registered company. For the purposes of these Terms and all related agreements, all rights, obligations, and references to "the Company" refer solely to the FindExperience™ trading entity and its operations. FindExperience™ operates as an independent brand; however, legal and commercial authority is vested in CultureTech Holdings as the trademark proprietor.
"Participant" means any individual who enrols in a FindExperience™ programme.
"Programme" means the structured work experience placement offered by FindExperience™.
"Partner Business" means any business that hosts a Participant on a project.
"Programme Tier" means any paid tier: Career Audit, Foundation Programme, Professional Programme, or Prestige Programme.
"CPA" means the Consumer Protection Act 68 of 2008.
"POPIA" means the Protection of Personal Information Act 4 of 2013.
2. Nature of the Programme
FindExperience™ facilitates placement of Participants on real projects within Partner Businesses for the purpose of building practical work experience, a professional portfolio, and documented credentials.
Important: FindExperience™ does NOT guarantee employment. Participation does not constitute an employment relationship. Results depend entirely on individual effort, market conditions, and employer decisions outside the Company's control.
The Company commits that all projects are genuine work tasks for real Partner Businesses. We do not provide fabricated or simulated work experience.
3. Enrolment & Agreement
A binding agreement is formed when: (a) the Participant submits an enrolment form; (b) the Company confirms acceptance in writing; and (c) the Participant makes payment of the required deposit or full fee. No placement is confirmed until payment has cleared.
Cooling-Off Period: In accordance with Section 16 of the CPA, Participants who enrolled via direct marketing may cancel without penalty within 5 business days of signing.
4. Fees, Payment & Refunds
All fees are quoted in South African Rand (ZAR). A minimum 50% deposit is required before any placement commences. Payment plans are available subject to a separate Payment Plan Agreement. The Participant remains liable for the full fee regardless of whether they complete the Programme.

Refund Policy: All fees are NON-REFUNDABLE once the Programme placement has commenced. Refunds are only considered if: (a) the Company cannot place the Participant within 60 days through no fault of theirs; (b) the CPA cooling-off period applies; or (c) a documented medical emergency prevents participation.
Refunds are NOT issued for change of mind, failure to complete projects, dissatisfaction with the Partner Business assigned, or failure to secure employment after completing the Programme.
5. Participant Obligations
By enrolling, the Participant agrees to: complete all deliverables to a professional standard; conduct themselves professionally with Partner Businesses and mentors; communicate proactively if unable to meet commitments; not misrepresent or exaggerate their Programme participation on CVs or applications; respect the confidentiality of Partner Business information; and not engage in conduct that damages the Company's or Partner Business's reputation.
6. Company Obligations
The Company commits to: making reasonable efforts to place each Participant on a suitable project within 30 days of confirmed enrolment; providing mentorship as described in the relevant Programme; issuing a Reference Letter, Portfolio, and Digital Certificate upon successful completion; and treating all personal information in accordance with POPIA.
7. Intellectual Property
Work produced by the Participant for a Partner Business belongs to that Partner Business unless otherwise agreed in writing. All Company materials, frameworks, and branding remain the exclusive intellectual property of FindExperience™.
8. Confidentiality
Participants may be exposed to confidential Partner Business information during the Programme. The Participant agrees to keep all such information strictly confidential during and after the Programme, not disclose it to any third party, and sign a separate NDA if required by a Partner Business.
9. Limitation of Liability
To the maximum extent permitted by South African law, the Company's total liability to any Participant shall not exceed the total fees paid for the relevant Programme. The Company is not liable for any indirect, consequential, or special damages including loss of employment opportunity, loss of income, or reputational harm.
10. Termination
The Company may terminate a Participant's enrolment immediately and without refund for breach of these Terms, dishonest or unethical conduct, abusive behaviour toward any representative or Partner Business, failure to make payment, or providing false information during enrolment.
11. Dispute Resolution
Disputes must first be raised in writing. The parties will attempt good-faith resolution within 14 days. If unresolved, disputes may be referred to mediation, arbitration, or the National Consumer Commission in terms of the CPA. These Terms are governed by the laws of the Republic of South Africa.
12. Force Majeure
The Company is not liable for failure to perform due to circumstances beyond its reasonable control, including natural disasters, pandemic, civil unrest, load shedding, or acts of government.

14. Representations & Warranties
The Participant warrants that: all information provided during enrolment is accurate and complete; they have the legal capacity to enter into this agreement; they are not enrolling on behalf of a third party without authorisation; and they will not use FindExperience™ materials, credentials, or frameworks to create a competing service or product.
15. Prohibited Conduct
Participants may not: share login credentials, programme materials, or internal frameworks with non-enrolled individuals; record, reproduce, or distribute any mentorship sessions without written consent; use the Company's name, logo, or branding in any public-facing material without prior written approval; or make false, exaggerated, or misleading claims about the nature, scope, or outcome of their Programme on any professional platform or legal document.
16. Indemnity
The Participant agrees to indemnify and hold harmless FindExperience™, CultureTech Holdings, and their employees, contractors, and partners against any claims, losses, damages, or expenses arising from: the Participant's breach of these Terms; misrepresentation of their Programme participation to any employer or third party; or any unlawful act committed by the Participant in connection with the Programme.
17. Programme Modifications
The Company reserves the right to modify programme content, mentors, partner placements, or timelines as required by operational circumstances. Participants will be notified of material changes in writing. Minor adjustments that do not materially affect the Programme's core value do not entitle the Participant to a refund or cancellation without penalty.
18. Entire Agreement & Severability
These Terms, together with any enrolment confirmation and payment plan agreement, constitute the entire agreement between the parties and supersede all prior understandings, whether oral or written. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
19. No Waiver
Failure by the Company to enforce any provision of these Terms at any time shall not be construed as a waiver of that right. All rights are cumulative and not exclusive of any other right or remedy available at law.
20. Online-Only Operations & Communication
FindExperience™ operates exclusively as an online service. All enrolment, onboarding, project delivery, mentorship, and communication occurs via email, WhatsApp, or virtual platforms. By enrolling, the Participant confirms they have reliable internet access and a functional email address capable of receiving communications. The Company is not liable for missed communications arising from spam filters, incorrect email addresses, or failure of the Participant to check their email or WhatsApp in a timely manner. All formally binding communications (including enrolment confirmation, payment receipts, and programme completion notices) will be delivered to the email address provided at registration. It is the Participant's responsibility to keep their contact information up to date.
21. Payment Plan Terms
Where a Participant elects a 50% deposit arrangement, the remaining balance becomes due and payable on or before the final day of the Programme, regardless of whether the Participant has received or reviewed their final deliverables. Where a customised payment plan is agreed in writing, those specific terms govern, but the total programme fee remains fully owed. Failure to pay any instalment on its due date constitutes a material breach and entitles the Company to: (a) suspend the Participant's access to programme materials and mentorship without notice; (b) withhold issuance of the Reference Letter, Portfolio, and Certificate until all outstanding amounts are settled; and (c) pursue recovery of the outstanding balance through available legal processes. Payment plan arrangements do not alter the non-refundable nature of fees paid. The Company does not offer payment plans via verbal agreement; all payment plan terms must be confirmed in writing via email.
22. Accuracy of Enrolment Information
The Participant confirms that all information submitted via the enquiry or enrolment form is accurate, complete, and not misleading. Providing false information — including but not limited to misrepresenting qualifications, identity, or financial circumstances — constitutes a material breach of these Terms and entitles the Company to terminate the Participant's enrolment immediately without refund. The Company reserves the right to verify any information provided and to request supporting documentation.
23. Screenshots, Recordings & Social Media
The Participant may not take screenshots, audio recordings, or video recordings of any live or recorded mentorship session, virtual meeting, or private communication without the prior written consent of the Company. Content from sessions may not be published on social media, shared with third parties, or used in any form without explicit written approval. The Company reserves the right to take legal action for unauthorised publication of its proprietary training content.
24. Non-Disparagement
The Participant agrees not to publish, broadcast, or otherwise communicate any false, misleading, or defamatory statements about FindExperience™, CultureTech Holdings, their staff, mentors, Partner Businesses, or other Participants in any online or offline forum, including social media, review platforms, or employer review sites. This clause survives termination of the Programme. Participants who wish to raise a complaint are encouraged to do so directly and in writing to findexperience@outlook.com before publishing any public commentary.
25. Testimonials & Marketing Consent
By completing the Programme, the Participant consents to FindExperience™ using anonymised feedback or, with separate written consent, named testimonials and profile information for marketing and promotional purposes. This includes use on the Company website, social media, and promotional materials. Consent for named use is optional and may be withdrawn in writing at any time. Withdrawal of consent does not affect material already published in good faith prior to the withdrawal request.
26. No Employment Relationship
Nothing in these Terms or the Programme creates an employment, labour broker, fixed-term employment, or independent contractor relationship between the Participant and FindExperience™ or any Partner Business. The Participant is not entitled to remuneration, benefits, leave, or any other rights conferred by the Basic Conditions of Employment Act or any equivalent legislation by virtue of their participation in the Programme.
27. Jurisdiction & Governing Law
These Terms are governed exclusively by the laws of the Republic of South Africa. The Participant consents to the non-exclusive jurisdiction of the South African courts in respect of any dispute arising from these Terms or the Programme. Where the Participant is based outside South Africa, they acknowledge that they are voluntarily engaging with a South African service provider and that South African law governs their enrolment.
